Puppy Purchase Contract
This contract is between Virginia Ashe also know as Elario Springers, herein after referred to as the "Seller" and/or "Breeder" and ________________________, herein after referred to as the "Buyer(s)".
Payment in full of the purchase price of $__________ by Buyer(s), Seller agrees to transfer to
Buyer(s) the ownership of one Male / Female English Springer Spaniel puppy, herein after referred to as the "Puppy" (regardless of age), from the mating of the sire and dam listed below:

Buyer's Acknowledgement
Buyer(s), by signing this contract, acknowledges that he/she is aware that there are some health problems that are not uncommon to the English Springer Spaniel breed. Some of the potential health problems are known to be genetic, some are believed to have some genetic predisposition, and the cause of others is unknown or is random in occurrence. Buyer(s) further understands that the technology does not exit to predetermine the genetic outcome of any breeding as respects to health, conformation, and temperament or performance ability.
The Breeder has made a good faith effort to determine that the Puppy's dam is free of inherited genetic disease, and has obtained like information on the sire to the extent available, and has made this information available to Buyer(s). Buyer(s) understands and acknowledges hat Seller can NOT predetermine the outcome of the breeding and therefore can make NO assurances that the Puppy will be free of inherited genetic or other disease, or that the Puppy will meet the Buyer's expectations as respects to conformation, performance or temperment.
Registration and Breeding
Seller will provide LIMITED American Kennel Club Registration. Seller will complete the registration form with Buyer's name and address and the Puppy's name as provided to the Breeder by the
Buyer(s). The Puppy's name will begin with the kennel name Elario under all circumstances.
Breeder will only amend the registration to FULL with co-ownership subject to the following conditions being met by the Buyer(s):
1-The Puppy must be a minimum of two years old before being mated
2-The Puppy must have a final OFA hip evaluation of Fair, Good or Excellent
3-The Puppy must have clear and normal ratings for CERF, Thyroid & Cardiac
4-The Puppy must be AKC pointed or a finished AKC Champion before being mated
Some special conditions may allow the Puppy to be bred if titled
in Obedience, Rally or Agility. The Buyer(s) must obtain prior
written approval from the Breeder.
5-The Buyer(s) is to notify the Breeder of planned breedings and make a copy of the outside pedigree available to the Breeder before the mating takes place. Breeder has the right to decline any breeding where the pedigrees are not a suitable match.
6-The Buyer(s) must provide legible copies of all health clearances before the
breeding is to take place
Spay/Neuter
The Puppy shall be spayed/neutered before the Puppy reaches 10 months of age. A legible copy of the spay/neuter certificate will be mailed to the Breeder. If, due to illness, the Puppy is unable to be spayed/neutered by 10 months of age the Buyer(s) will provide the Breeder with documentation from a licensed veterinarian stating the reason the Puppy is unable to be spayed/neutered. Once the condition has been rectified the Buyer(s) agree to spay/neuter the Puppy.
Females only: Should the Puppy come into heat before being spayed Buyer(s) agrees to keep the Puppy confined and only leash walked for 28 days so that no accidental breeding occurs. Should an accidental breeding occur the Breeder is to be notified immediately.
Health Warranty
Breeder warrants that if the Puppy should be afflicted with an inherited disease of the hips or heart that renders the Puppy unable to perform as indicated by Buyer(s), Breeder will refund the
Full Purchase Price subject to the following conditions
1-Buyer(s) notifies Breeder promplty after such condition is diagnosed and not later than
the Puppy reaches 25 months of age
2-Buyer(s) provides Breeder with documentation of the inherited genetic disease
3-The Puppy must not have been bred if a female or must not have been
allowed to sire a litter if male
4-The Puppy must have been maintained in good physical condition with good muscle tone through proper exercise and not allowed to become overweight
5-The Puppy has received proper immunizations and monthly heartworm and flea/tick preventative
6-The Puppy must be returned to the Breeder along with the Puppy's registration
papers properly signed, transferring ownership back to Breeder
7-Buyer(s) acknowledges that special coat care, conditioning, training and feeding are necessary
8-Buyer(s) agrees to promptly contact the Breeder when the Puppy passes on and supply to the Breeder details as to the cause of death. We understand this can be a very difficult time to discuss the loss so a letter or email will be suitable notification.
ACL tears, heartworm and other "maintenance" injuries/illnesses are NOT covered
under this health warranty.
Pickup/Shipping
As soon as is reasonably possible after the Puppy is 8 weeks of age for Pickup or 10 weeks of age for Shipping, Breeder will make the Puppy available to the Buyer(s). Breeder will ship the puppy to the Buyer(s) buy method chosen by the Buyer(s). Buyer(s) shall provide an acceptable shipping crate and the Buyer(s) shall be responsible for all shipping expenses which shall be
paid in advance of shipping.
Buyer(s) Responsibility
Buyer(s) agrees to conduct him/herself as a responsible dog owner.
Buyer(s) agrees that Buyer(s) is solely responsible for all costs and expenses of and related to the ownership of the Puppy including but not limited to feeding, veterinary care and training.
Buyer(s) further agrees that Buyer(s) is solely responsible for any and all actions of the Puppy and agrees to hold Breeder harmless from any and all claims for Bodily Injury and/or Property Damages caused or alleged to have been caused by the Puppy.
Buyer(s) agree that if, for any reason whatsoever, they can no longer keep the Puppy, the Puppy is to be returned to the Breeder. The Puppy is not to be given to any rescue organization,
shelter or other persons. Should the Buyer(s) transfer ownership of the Puppy
to any party other than the Breeder, the Breeder reserves the right to
take legal action to regain ownership of the Puppy at the Buyer(s) expense.
By signing this Contract of Sale, Buyer(s) accepts all conditions contained herein.
